(a) Grazing lessees desiring to construct other improvements of a permanent nature, such as housing, barns, sheds, slaughterhouses, silos and grain or hay storage buildings, etc., within the grazing lease area, must apply for either the sale or lease of the lands under chs. 54, 57, or 58 of this title. (b) If the proposed lease or sale is considered to be in the best interest of the state, the lands involved will be excluded from the grazing lease and may be leased or sold in accordance with existing lease or sale procedures. In no event may the lands sold or leased exceed 40 acres, except that this limitation does not apply for a sale of an agricultural interest under ch. 57 of this title.
