Section 11.67.930. Purpose and procedure.

  • 	(a)  State land or an interest in state land will, in the director's discretion, be disposed of by quitclaim deed to the United States under AS 38.05.035(b)(9) if  
    		(1) the director determines that the original conveyance of the land from the United States to the state was wrongful or erroneous because  
    			(A) the land was subject to a valid private claim of legal or equitable title; or  
    			(B) the land conveyed was not selected by the state or was not available for state selection; or  
    			(C) the state's title to the land is otherwise defective;  
    		(2) a finding is made under AS 38.05.035(e) that the interests of the state will best be served; and  
    		(3) public notice of the finding required by (2) of this subsection is given under AS 38.05.945.  
    	(b)  A quitclaim deed issued under this section is effective as a transfer of legal title to the United States only upon signature of acceptance on the deed by an authorized official of the United States.
