(a) The division will, in its discretion, authorize a purchaser under a timber sale contract under this chapter to (1) construct, reconstruct, and maintain roads, bridges, and other transportation facilities needed for cutting and removing timber; and (2) construct in the sale area temporary buildings or other improvements necessary for logging or processing timber. (b) Transportation facilities and other improvements constructed by a purchaser under (a) of this section must be located, constructed, and maintained in accordance with the provisions of the purchaser's timber sale contract and, unless otherwise specified in the contract and except as provided in 11 AAC 71.305, must remain on the sale area as property of the state. (c) Design and location plans for transportation facilities constructed under (a) of this section must comply with the purchaser's contract.
