(a) Within 60 days after the close of the public comment period required by 11 AAC 83.311, the commissioner will issue a written decision approving or disapproving the unit agreement, in which he states the basis for his decision after considering the provisions of 11 AAC 83.303. (b) If the commissioner determines that the provisions of 11 AAC 83.303 are not met, the commissioner will, in his discretion, propose modifications which, if accepted by the parties to the proposed unit agreement, would qualify the agreement for approval. (c) No unit will be approved unless parties to the unit agreement hold sufficient interest in the unit area to give reasonably effective control of operations and at least one lease or portion of a lease in the unit area is a state lease.
