An applicant may apply for a credit under this chapter only for an eligible project. To be considered as an eligible project, the proposed activity must be (1) specified in AS 41.09.010; (2) described in a plan submitted under 11 AAC 89.017 providing sufficient detail to determine whether the proposed activity will provide data to enhance the state's resource evaluation program; and (3) approved by the commissioner as meeting the purposes and requirements of this chapter and AS 41.09.
