(a) Notice of an application for a reservation of water will be provided in accordance with AS 46.15.133 and 11 AAC 93.080. In addition, the commissioner will provide notice to the Alaska Departments of Fish and Game and Environmental Conservation, to any federal or state agency responsible for managing land in the vicinity, and to any local government in whose jurisdiction the proposed reservation of water would occur, as well as to any other interested party who has filed a request with the department to receive notice. (b) Timely objections received following notice of an application for a reservation of water will be considered in accordance with 11 AAC 93.090. (c) Hearings regarding an application for a reservation of water will be held in accordance with AS 46.15.133 and 11 AAC 93.110. (d) The commissioner's decision to grant, conditionally grant, or deny an application for a reservation of water will be summarized by written findings of fact and conclusions of law, including justification of any special conditions to which the reservation is subject. In determining whether the proposed appropriation is in the public interest, the commissioner will consider the criteria set out in AS 46.15.080(b).
