Section 11.95.270. Designation and marking of a riparian retention area.

  • 	(a)  Where timber retention is required and where the required riparian retention area abuts or is within a harvest unit, an operator shall mark the limits of the riparian retention area before harvest begins. On private land in Region I, marking of riparian areas along Type I-C and I-D water bodies is not required.  
    	(b)  The following standards apply for marking a riparian retention area that abuts or is within a harvest unit:  
    		(1) each marking must be visible from adjacent markings;  
    		(2) marking must be by flagging, painting, or another identification system.  
    	(c)  A water body or its timber retention area must be marked while the area is free of snow cover that would prevent accurate marking, unless a water body is large, incised, or otherwise identifiable when under snow cover.  
    	(d)  A tree on the boundary of a riparian retention area is within the riparian retention area if over 50 percent of the diameter of the bole of the tree is within the riparian retention area. For the purposes of this section, a diameter of the bole of the tree is measured at four and one-half feet above ground level or at the top of the root collar, whichever is higher.
