(a) A dispenser registered under 12 AAC 52.855(a) to receive information from the controlled substance prescription database may not (1) share user account information, login names, or passwords with any person, regardless of whether that person is also an authorized user of the controlled substance prescription database; (2) permit any authorized person to use the practitioner's or pharmacist's user account, account name, or password in order to access the controlled substance prescription database regarding any person or for any purpose. (b) Information obtained from the controlled substance prescription database shall be kept confidential in accordance with the confidentiality requirements of P.L. 104-191 (Health Insurance Portability and Accountability Act of 1996 (HIPAA)), 42 C.F.R. Part 2, and 45 C.F.R. Parts 160, 162, and 164.
