Section 13.03.065. Overtaking a vehicle on the left; limitations.

  • 	(a)  Except as provided in 13 AAC 03.055, the driver of a commercial motor vehicle overtaking another vehicle proceeding in the same direction shall pass at a safe distance to the left of the vehicle being overtaken, and may not return to the right side of the roadway, until safely clear of the vehicle being overtaken. Upon audible signal, the driver of the vehicle being overtaken shall give way to the right in favor of the overtaking vehicle. If the driver of the overtaking vehicle must perform the passing maneuver in a lane reserved for oncoming traffic, the driver of the vehicle being overtaken may not increase the speed of the vehicle until the overtaking commercial motor vehicle has passed and driven back to the right side of the roadway.  
    	(b)  A commercial motor vehicle may not be driven to the left side of the center of a roadway when overtaking and passing another vehicle proceeding in the same direction unless authorized by this chapter and unless the left side of the roadway is clearly visible and free of oncoming traffic for a sufficient distance ahead to permit the overtaking and passing to be completed without interfering with the flow of traffic approaching from the opposite direction or with a vehicle overtaken. The overtaking commercial motor vehicle must return to an authorized lane of travel as soon as practicable and, if the passing movement involves the use of a lane authorized for a vehicle approaching from the opposite direction, before coming within 200 feet of an approaching vehicle.
