(a) If the agency establishes or modifies a support order administratively, the agency will require health care coverage for the children covered by the support order if health care coverage is available to either or both parents at a reasonable cost and accessible to the children, as defined in Alaska Rule of Civil Procedure 90.3(d). The agency will include in the support order a provision allowing a credit or debit for one-half of the cost of the health care coverage depending on which parent purchases the coverage, unless the agency finds good cause to order a credit or debit in a different amount. (b) When the agency is enforcing a child support order issued by a tribunal other than the agency, the agency will seek a modification (1) through the appropriate legal process to add a provision requiring health care coverage for the children covered by the support order if the order does not already include a health care coverage provision, and allowing a credit or debit for one-half of the cost of the health care coverage depending on which parent purchasers the coverage, unless good cause exists to request a credit or debit in a different amount; or (2) of the order's existing health care coverage provision if the provision does not comply with state or federal law. (c) Repealed 11/30/2002.
