Section 15.150.680. Joint evaluation committee.

  • 	(a)  The Corporation, before entering into any commitments for the disposition of any real property described in 15 AAC 150.600 on which substantial development will occur, will first permit all competing proposals for the development of that real property to be presented to a joint evaluation committee for review and comment. The joint evaluation committee consists of representatives from the governing body of the municipality in which the real property is located and members of the board of directors of the Corporation. The joint evaluation committee will not select one competing proposal over another but, rather, will express an opinion of preference among the competing proposals.  
    	(b)  Upon the conclusions of the review of the joint evaluation committee, the joint evaluation committee will, in its discretion, recommend that all competing proposals be presented to all members of the governing body of the municipality in which the real property is located. However, the presentation of all competing proposals before the governing body is not mandatory and will be within the discretion of the governing body as to whether they wish to hear the presentations. Upon presentation of the competing proposals before the governing body of the municipality in which the real property is located, that body shall not select one proposal over another but, rather, will indicate a preference among the competing proposals.  
    	(c)  In the disposition of real property on which substantial development will not occur, competing proposals need not be reviewed by the joint evaluation committee or by the governing body of the municipality in which the real property is located. However, the Corporation will give written notice to the municipality at least 30 days before the disposition of its intent to dispose of the real property to a particular purchaser. In those municipalities where substantial development will occur, the municipalities do not wish to participate in a joint evaluation committee, there will not be a joint evaluation committee. In its place, the Corporation will submit to the governing body of the municipality the proposals for its comments, opinions, and approval.  
    	(d)  The selection and award of sale among competing proposals will be made by the board. At least 30 days before the selection of a competing proposal, the Corporation will give written notice of its intent to select the proposal. However, the Corporation will not execute any contract to convey or sell any real property until and unless all grievances or complaints that may be filed, because of the award, under 15 AAC 150.740 and 15 AAC 150.760 are resolved.
