(a) The department may issue an advisory notice to a permittee, licensee, or registered vendor if an incident occurs or a defect is identified that could result in a violation of AS 05.15 or this chapter. An advisory notice may not constitute grounds for administrative or court action against a permittee, licensee, or registered vendor, but may constitute grounds for issuance of a notice of violation if the incident or defect continues uncorrected. A copy of an advisory notice will be filed only in the enforcement file of a permittee, licensee, or registered vendor. (b) The department may issue a notice of violation to a permittee, licensee, or registered vendor if the department has reason to believe that a violation of AS 05.15 or this chapter has occurred or might occur. (c) The department will place a notice of violation and any written response in the permanent record of the department for the permittee, license, or registered vendor to whom the notice was issued.
