(a) If the airport manager determines that it is necessary to ensure the security of persons or property on the airport or to comply with federal or state law, the manager may post areas on the airport as restricted. A person is prohibited from entering or remaining in an area on an airport that is posted as restricted unless (1) the person is wearing a current airport identification badge issued by the manager to the person and is in compliance with the terms and conditions applicable to use of the badge established by the manager under (b) of this section; (2) the person is an authorized FAA safety or TSA security inspector on official government business and carrying current identification as required under applicable FAA or TSA regulations; or (3) the entry is first authorized by the airport manager. (b) The airport manager may establish qualifications for receipt of an airport identification badge and may issue an identification badge to a qualified person to show that the person has permission to enter an area posted as restricted under (a) of this section. The manager shall establish terms and conditions applicable to the use of identification badges issued under this subsection. A person who accepts an airport identification badge agrees to comply with those terms and conditions. The manager shall provide to each person issued an identification badge a copy of the terms and conditions for review at the time of issuance and shall require each person who accepts a badge to acknowledge by signature that the person has had an opportunity to review those terms and conditions. (c) A person who accepts an airport identification badge shall pay the fee for an identification badge established under 17 AAC 42.125. (d) The airport manager shall enter onto a premises to erect and maintain a barrier if the manager determines that a barrier is necessary to comply with applicable law for prevention of unauthorized or inadvertent entry to a restricted area of an airport or to maintain security acceptable to the FAA. Except in the case of an emergency or threat to public safety, the manager shall give prior notice to a lessee, permittee, or concessionaire before erecting a barrier on the lessee's, permittee's, or concessionaire's premises. To the extent practical, the manager shall erect the barrier in a location where the barrier will not disrupt the operations of the lessee, permittee, or concessionaire. (e) If the premises of a lessee, permittee, or concessionaire is within or adjacent to a restricted area, the lessee, permittee, or concessionaire shall ensure that only authorized persons enter or remain in the restricted area. (f) A person may not photograph or film a passenger screening area or copy or duplicate an airport identification badge without the written approval of the airport manager.
