Direct costs to the state resulting from a private sector vessel's use of marine highway system terminal facilities will be passed on directly to the private sector user. These direct costs are in addition to the charges stated in the Alaska Marine Highway System Terminal and Terminal Operation Tariff and the liquidated damages stated in 17 AAC 70.280. These charges include the repair of damages caused to the ferry terminal by the vessel, its passengers, and their vehicles, or any additional amount the state is required to pay its contractors for delays in construction or repairs of the terminal facility because of the vessel's operations.
