Section 17.70.310. Priority of use among private sector vessels.

(a) A private sector operator may make application at any time to use ferry terminal facilities on a particular date at a particular time. However, the issuance of a terminal use authorization or contract for a particular date and time is subject to prior assignment by previous authorization or contract to another private sector operator, vessels of the Alaska Marine Highway System, and other operational or maintenance uses. (b) All applications for terminal facility use received by the Alaska Marine Highway System will be screened to determine whether conflicts between applicants exist for particular dates, times, or other uses. Applications will be processed in the order received. If no conflicts exist and the system director makes the determination as required by 17 AAC 70.250(c) or (d), the applicants will receive the dates requested. Unsuccessful applicants will be assigned the next available dates and times with priority established according to the date the applications were received by the Alaska Marine Highway System. (c) Use of marine highway system terminal facilities by Alaska Marine Highway System vessels is not subject to the provisions of this section.
