Section 17.70.410. Application of interport differential to bids.

If the lowest cost of a bid from a shipyard facility located in the state, after consideration of the Alaska bidder preference set out in AS 36.30.170, is greater than the lowest cost of a bid from a shipyard facility located outside the state, after inclusion of the interport differential identified by the commissioner and calculated under 17 AAC 70.420, the proposed cost of the maintenance or repair work of a vessel is unreasonable within the meaning of AS 36.90.049(a). The commissioner will document a finding of unreasonability in writing, and will include the written finding and all relevant documents in the procurement file.
