(a) The department will hold a public hearing on a pesticide permit application under 18 AAC 90 if (1) no more than 30 days after the second publication of notice under 18 AAC 15.050(c), a hearing is requested by (A) 50 residents of the affected area; or (B) the governing body of an affected municipality; or (2) the department finds that good cause exists, even if a hearing has not been requested under (1) of this subsection. (b) The department will hold a public hearing on an application for a short-term variance from water quality standards, or on a permit or approval application, if it determines that good cause exists. (c) The hearing will be held no sooner than 15 nor more than 30 days following publication of the notice under (e) of this section. (d) The public hearing will be held at the closest practicable location to the site of the operation. (e) Notice of the time, place, and scope of the hearing will be published in a newspaper of general circulation for the area that would be affected by the operation. (f) The appropriate division director shall appoint a designee to preside at the hearing. Testimony will be presented in the order, and subject to time limitations, established by the presiding officer. (g) At the close of each witness' testimony, the witness may be questioned by the presiding officer and the department staff. (h) A hearing under this section will be tape recorded.
