Section 18.30.955. Waiver of provisions.

(a) The department will, in its discretion, waive a provision of this chapter if it determines that the health and protection of the public and the satisfaction of the purpose of the provision is reasonably assured and the requirements of applicable statutes are satisfied. (b) An application for a waiver must be made in writing to the director, environmental quality operations, and must include (1) identification of the provision for which the waiver is requested; (2) reasons why the provision cannot be met or would create an undue hardship; and (3) a description of the alternative method proposed for meeting the purpose of the provision that is requested to be waived. (c) A request for a waiver will be answered in writing within 30 days after its receipt.
