(a) The owner or operator of a new or existing MSWLF or a lateral expansion located within 10,000 feet of an airport runway end used by turbojet aircraft, or within 5,000 feet of an airport runway end used by only piston-type aircraft, shall demonstrate that the MSWLF is designed and operated so that it does not pose a bird hazard to aircraft. (b) An owner or operator proposing to site a new MSWLF or a lateral expansion within a five-mile radius of an airport runway end used by turbojet or piston-type aircraft shall notify the affected airport and the Federal Aviation Administration at the time the permit application is submitted to the department. (c) The owner or operator shall retain the documentation used to satisfy (a) of this section in the operating record. (d) In this section, (1) "airport" means a place for the landing and take-off of aircraft, which place is open to the public without prior permission; and (2) "bird hazard" means an increase in the likelihood of bird-aircraft collisions that might cause damage to the aircraft or injury to its occupants.
