(a) An application for a permit under 18 AAC 75.800 must be made on forms supplied by the department. The application must be sent to the department at least 60 days before the proposed discharge is to begin. The application must include (1) the name, address, and telephone number of the applicant; (2) a detailed description of the proposed project, including plans for restoration; (3) a description of the geographical area involved; and (4) a description of the expected flow pattern of any water to be affected by the project. (b) The department will (1) send a copy of a completed application received under this section to the departments of fish and game, natural resources, commerce and economic development, and health and social services; and (2) publish notice of the application as provided in 18 AAC 15.050. (c) The department will attach terms and conditions to the permit which it finds are necessary to protect the environment and potentially affected property owners. A permit is further subject to the permittee's stipulation and agreement to (1) modify activities if served with a notice under 18 AAC 75.820; or (2) immediately cease all permitted activities if served with a notice to terminate under 18 AAC 75.830.
