(a) The review provisions of 18 AAC 15.185 and 18 AAC 15.195 - 18 AAC 15.340 apply to review of any condition imposed in an APDES permit or any denial of an APDES permit application. (b) The commissioner or the commissioner's designee will, under 18 AAC 15.220, determine the action to be taken on a request for an adjudicatory hearing. If an adjudicatory hearing or a hearing on the record is granted, the commissioner or the commissioner's designee may specify the issues to be addressed through the hearing process to the Office of Administrative Hearings, created under AS 44.64.010. (c) An APDES permit is not automatically stayed by the filing of a request for an adjudicatory hearing on the permit. The commissioner or the commissioner's designee will decide a request to stay an APDES permit.
