(a) An APDES permit must include limitations established under 18 AAC 83.430 and 18 AAC 83.435 to control toxic pollutants that the department determines are or may be discharged at a level greater than the level achievable by the technology-based treatment requirements appropriate to the permittee under 40 C.F.R. 125.3(c), adopted by reference in 18 AAC 83.010. (b) In determining whether to include limitations on toxic pollutants in a permit under this section, the department will consider information reported in a permit application under 18 AAC 83.310 or in a notification under 18 AAC 83.610, or other relevant information. The fact sheet must explain the development of limitations included in the permit. (c) Limitations included in a permit under this section may include limitations on (1) the toxic pollutants identified for limits under (a) of this section; or (2) other pollutants which, in the determination of the department, will provide treatment of the pollutants to the levels required by 40 C.F.R. 125.3(c), adopted by reference in 18 AAC 83.010.
