Section 18.90.225. Modification, suspension, or revocation of registration.

(a) If the department finds that a pesticide or its labeling does not comply with FIFRA, or when necessary to prevent a pesticide from having an unreasonable adverse effect on human health, safety, or welfare, animals, or the environment, the department will, in its discretion, modify, suspend, or revoke the registration of that pesticide issued under 18 AAC 90.215, using the criteria in 18 AAC 90.215(b), or will pursue other sanctions provided by law. (b) The department will provide written notice to the producer of the pesticide of the department's action under (a) of this section within 10 working days after the department decides to modify, suspend, or revoke registration. A producer who disagrees with the department's decision may (1) appeal the decision under 18 AAC 90.900; and (2) request an adjudicatory hearing under 18 AAC 15.195 - 18 AAC 15.340.
