Section 18.90.705. Stop sale, use, or removal orders.

If the department has reasonable cause to believe that a pesticide or device is being distributed, stored, transported, offered for sale, or used in violation of this chapter, the department will, in its discretion, serve a written stop sale, use, or removal order to the owner or custodian of the pesticide or device. If the owner or custodian cannot be timely served, the department will, if possible, attach the order to the pesticide or device and attempt to notify the owner or custodian or the person who has registered the pesticide under 18 AAC 90.200 - 18 AAC 90.235. The order remains in effect until released in writing by the department or vacated or terminated by a court. Issuance of a stop sale, use, or removal order does not preclude other enforcement actions authorized by law.
