Section 2.12.956. Referral to arbitrator.

(a) If the total amount of the claim and any counterclaim is less than $250,000, or if the total amount of the claim and any counterclaim is $250,000 or more and the agency agrees to arbitration, the commissioner shall refer the appeal to a single neutral arbitrator. (b) If the total amount of the claim and any counterclaim is more than $1,000,000, and the agency agrees to arbitration, the commissioner may refer the appeal to a panel of three neutral arbitrators. The parties may, by mutual agreement, waive a panel and have the claim and any counterclaim heard by a single arbitrator. (c) The commissioner shall provide the arbitrator or panel with copies of the notice of appeal, the arbitration request, the answering statement, and any supporting documents filed by the parties with the commissioner.
