Section 20.05.681. Point system for the Kodiak roe herring purse seine fishery.

  • 	(a)  Past Participation. A maximum of 26 points will be awarded to an applicant for past participation in the fishery based upon the following:  
    		(1) Past participation as a purse seine gear operator. Points will be awarded to an applicant based on threshold participation of at least one landing and active participation of more than 2,000 pounds, as follows:

    		(2) Part participation as a crewmember. In years when an applicant did not participate as a gear operator, but did participate as a crewmember in the fishery, 1 point will be awarded for each year of participation, 1975 - 1980.  
    	(b)  Consistent Participation. A maximum of 21 points will be awarded to an applicant for consistent participation in the fishery as a gear operator based on either of the following:

    	(c)  Economic Dependence. A maximum of 28 points will be awarded to an applicant for economic dependence on the purse seine fishery, in accordance with the following:  
    		(1) Points for income dependence will, in the commission's discretion, be awarded for each year, 1978 - 1980, in which an applicant participated as a gear operator. A maximum of 9 points will be awarded based on an income-dependence percentage which is calculated by dividing the applicant's annual Kodiak roe herring purse seine fishing gross income earned as a gear operator by the sum of that annual catch value and the applicant's nonfishing occupational income, and multiplying the result by 100. Minimum percentages for income dependence:

    		(2) The commission will award a maximum of 2 points to an applicant for investment in a vessel as of December 31, 1980 which was used or to be used in a commercial roe herring purse seine fishery in the State of Alaska.  
    		(3) The commission will award a maximum of 8 points to an applicant for ownership of gear which was used or to be used in the Kodiak roe herring purse seine fishery, as follows:  
    			(A) 4 points if the applicant owned the gear on May 1, 1979;  
    			(B) 4 points if the applicant owned the gear on May 1, 1980; and  
    			(C) 4 points if the applicant owned the gear on December 31, 1980.  
    		(4) If two or more eligible applicants share in the investment in vessel or gear, the commission will award points under (2) and (3) of this subsection based on the ratio of the applicant's investment interest to the total investment interest of all applicants.  
    		(5) Availability of alternative occupations in the location of the applicant's domicile as of the qualification date. (Maximum of nine points possible.)  
    			(A) An applicant is entitled to 9 points if his or her domicile is located  
    				(i) more than 30 road miles from the boundary of a "place" with a population of at least 5,000 and less than 10,000 as of the 1980 census, and  
    				(ii) more than 40 road miles from the boundary of a "place" with a population of 10,000 or more as of the 1980 census, and  
    				(iii) more than 40 road miles from an "urbanized area" as of the 1980 census.  
    			(B) An applicant is entitled to 5 points if his or her domicile is located  
    				(i) within 30 road miles of the boundary of a "place" with a population of at least 5,000 and less than 10,000 as of the 1980 census, and  
    				(ii) more than 40 road miles from the boundary of a "place" with a population of 10,000 or more as of the 1980 census, and  
    				(iii) more than 40 road miles from an "urbanized area" as of the 1980 census.  
    			(C) An applicant is entitled to 0 points if his or her domicile is located within 40 road miles of the boundary of a "place" with a population of 10,000 or more, or within 40 road miles of an "urbanized area" as of the 1980 census.  
    			(D) An applicant from a 0- or 5-point area may receive up to the maximum of 9 points through a special showing that there is no reasonable daily access from the applicant's domicile to the "places" and "urbanized areas" referred to in (B) or (C) of this paragraph, as applicable.  
    			(E) "Place" means an area recognized as a place in Appendix A of the United States Department of Commerce 1980 Census of Population, Volume 1, "Characteristics of the Population," Chapter B, "General Population Characteristics," Part 3, which is incorporated into this section by reference.  
    			(F) "Urbanized area" means a city of 50,000 or more and its surrounding urban areas; it is defined specifically in Appendix A of the United States Department of Commerce 1980 Census of Population, Volume 1, "Characteristics of the Population," Chapter B, "General Population Characteristics," Part 3, which is incorporated into this section by reference.
