In 20 AAC 05.794 - 20 AAC 05.799, unless otherwise specified, (1) "commercially harvested" means the lawful taking and selling of herring spawn-on-kelp while actively involved in a herring pound operation by a CFEC interim-use permit holder, who (A) was actively engaged in the harvest of herring spawn-on-kelp from pounds in a manner consistent with the regulations and requirements of the Alaska Department of Fish and Game, including having held a pound permit; (B) shared in any earnings from that harvest; and (C) sold herring spawn-on-kelp sales in accordance with regulations governing the sale or use of commercially gathered herring spawn-on-kelp applicable at the time of sale, including regulations regarding proper completion of reports required of processors, buyers, and fishers; (2) "pound built and permitted" means a herring pound that the operator must have had built and anchored, and for which the operator obtained the permit required by 5 AAC 27.185 for that pound.
