(a) If injection does not occur into, through, or above freshwater, the commission will, authorize requirements for a well or project that are less stringent than the requirements in this chapter for the radius of investigation established under 20 AAC 25.252(h) or 20 AAC 25.402(b), casing and cementing, the tubing and packer mechanical integrity, operation, monitoring, and reporting, to the extent that the commission determines that the reduction in requirements will not result in an increased risk of movement of fluids into freshwater. (b) At the discretion of the commission, pilot projects for enhanced recovery using a technology not proved feasible under the conditions in which it is being tested may be operated with less stringent requirements for well construction, operation, monitoring, and reporting, if the project will not result in an increased risk of fluid movement into freshwater sources.
