(a) Upon the motion of the commission, or the request of an affected owner or operator at any time after the discovery of oil or gas in a field or pool, the commission will hold a hearing in accordance with 20 AAC 25.540, and the commission will issue an order, based upon the evidence presented, classifying the pool as an oil or gas pool in a field and prescribing rules to govern the proposed development and operation of the pool. In the pool order, the commission will establish requirements (1) that the commission considers necessary to prevent waste, protect freshwater, protect correlative rights, and ensure a greater ultimate recovery of oil and gas; and (2) based on the operating and technical data presented. (b) The commission will, in its discretion, amend pool orders in accordance with the procedures set forth in 20 AAC 25.540.
