Latest version.
-
(a) During an investigation, the ombudsman may request the cooperation of the agency that is the subject of the complaint, in order to provide a remedy for the complaint by persuading the agency to act or to reconsider action already taken; or, if no remedy is warranted under the circumstance, by providing the complainant with an explanation of the administrative act. (b) If the agency's cooperation facilitates resolution of the complaint, the ombudsman may close the complaint without completing an investigative report. However, the ombudsman may proceed with an investigative report if the complaint presents systemic issues not resolved by a remedy for the individual complainant.
