Section 22.05.069. Substance abuse screening.

  • 	(a)  Substance abuse screening of individual prisoners may be conducted at any time to detect, control, and identify the use of unlawful or unauthorized drugs, including alcohol, and as an evaluative tool to confirm prisoner compliance with a treatment program.  
    	(b)  The commissioner will establish procedures for the conduct of substance abuse screening in facilities to ensure  
    		(1) that screening is done only for the purposes set out in (a) of this section and not for purposes of harassment;  
    		(2) the validity of the testing mechanism and methods used;  
    		(3) that the screening specimen is properly preserved and maintained viable throughout the testing process; and  
    		(4) that the specimen is preserved for independent and subsequent testing at the prisoner's discretion and personal expense, in accordance with procedures established by the commissioner.
