Section 22.20.090. Calculation and notice of eligibility date.

(a) Within 30 days after receipt of the final judgment, the department shall calculate the parole eligibility date of each prisoner eligible for discretionary parole under 22 AAC 20.005 - 22 AAC 20.085. (b) The department shall give the prisoner and the board written notification of the eligibility determination. (c) If the prisoner disagrees with the parole eligibility date calculated under (a) of this section, the prisoner must notify the board in writing of the disagreement and the reasons for believing the calculation is in error. (d) The department shall refer to the board, in writing, a case in which a prisoner's discretionary parole eligibility does not appear to be covered by 22 AAC 20.005 - 22 AAC 20.085. (e) The board or a staff member designated by the board will review and calculate the parole eligibility date of a case brought to the board's attention under (c) or (d) of this section and will notify the prisoner and the department in writing of the correct calculation. This calculation by the board or the designated staff member is the official eligibility date.
