(a) The chief procurement officer may determine the contractual provisions, terms, and conditions of solicitations and contracts, if the provisions, terms, and conditions are not contrary to statutory or regulatory requirements governing the procurement. (b) The chief procurement officer shall develop and maintain standard contract terms subject to review and approval as to form by the attorney general. Modification of these standard terms is subject to review and approval as to form by the attorney general. (c) Contractual terms and conditions may not have the effect of unnecessarily limiting competition or exclusively requiring a proprietary supply, service, or construction item resulting in procurement from a single source unless no other requirement will suffice. (d) The standard contract terms will be included or referenced in all invitations to bid under 3 AAC 100.220 and requests for proposals under 3 AAC 100.350.
