Section 3.100.340. Conditions for use.

  • 	(a)  The procurement officer may procure supplies or services by competitive sealed proposals if the procurement officer determines that the use of competitive sealed proposals is more practical or advantageous to the authority than competitive sealed bidding.  
    	(b)  The following types of supplies and services for which the use of competitive sealed bidding is either not practicable or not advantageous to the authority may be procured by competitive sealed proposals without a written determination by the procurement officer:  
    		(1) professional services contracts;  
    		(2) architectural, engineering, and land surveying contracts;  
    		(3) lease space;  
    		(4) supplies and services for clean-up of oil and hazardous substances;  
    		(5) design-build construction contracts;  
    		(6) design-build-operate contracts.  
    	(c)  Award under competitive sealed proposals will be made to the responsive and responsible offeror who provides the highest ranked proposal based on the criteria and evaluation processes identified in the request for competitive sealed proposals if the authority and the offeror are able to negotiate a contract for the benefit of the authority consistent with the solicitation and the offeror's proposal.
