Section 3.102.170. Reconsideration and appeal of financing decision.

  • 	(a)  If a guarantee or loan request made under this article is denied, tabled, or significantly modified by the authority, an applicant may file a written request for reconsideration within 15 working days after receipt of notice of the authority's decision.  
    	(b)  The authority will, in its sole discretion, reconsider a request upon a showing by the applicant that  
    		(1) there has been a substantial change in circumstances;  
    		(2) additional relevant information is provided to the authority; or  
    		(3) administrative errors were made by the authority.  
    	(c)  The decision of the authority with regard to reconsiderations is final unless the applicant appeals to the board. To appeal to the board, the applicant must file a written notice of appeal with the executive director not later than 20 working days after being notified in writing of the rejection of the request for reconsideration. The board may allow the applicant to make a presentation on its appeal or the board may limit its consideration of the appeal to the documents submitted to the authority with the application and the request for reconsideration. The decision of the board to reject an appeal will constitute the authority's final decision on the application.
