  • 	(a)  Procurement records under this chapter are public records in accordance with AS 40.25.110.  
    	(b)  If a bidder or proposer submits a procurement record and request that it be kept confidential, the chief procurement officer shall determine whether the procurement record appears to be confidential and notify the bidder or proposer of the determination. If the authority receives a public records request for a procurement record determined to appear to be confidential, the authority will notify the bidder or proposer of the public records request to enable the bidder or proposer to protect the confidentiality of the procurement record.
