Except upon a special showing to the commission of significantly changed conditions, a petition will not be accepted for filing that (1) is substantially similar to a petition denied by the commission during the immediately preceding three years; for purposes of this paragraph, the three-year period will be measured from the date that the denial is final at the agency level, including reconsideration, or through the end of the appeal process, whichever is later; (2) is substantially similar to a petition rejected by the legislature or rejected by the voters during the immediately preceding two years; or (3) requests a substantial reversal of a decision of the commission that first became effective during the immediately preceding two years.
