An insurer shall file for approval by the director any form that will be used if the creditor or insurer requests or requires evidence of individual insurability. An insurer shall develop and maintain in its files underwriting standards that include the type of underwriting questions that will be asked and the class of proposed insureds that will be requested or required to respond to those questions as a condition of obtaining credit insurance. The underwriting standards may not unfairly discriminate among individuals of the same class. An insurer shall inform all group policyholders, creditors, and other insurance producers of the applicable underwriting standards and ensure that these standards are followed by the group policyholders, creditors, and other producers.
