	(a)  The board may issue a restaurant or eating place license under AS 04.11.400(g) upon a showing that  
		(1) repealed 8/24/2001;  
		(2) there is community support, which must be shown by a petition signed by a majority of the residents 21 years of age or over who reside within one mile of the proposed premises; and  
		(3) the governing body of the municipality in which the licensed premises are to be located approves the application.  
	(b)  Renewal of a license issued under AS 04.11.400(g) will, in the board's discretion, be denied if the license ceases to be necessary to the public convenience.

As of Register 166 (July 2003), and acting under AS 44.62.125 (b)(6), the regulations attorney relocated former 15 AAC 104.335 to former 13 AAC 104.335, to reflect Executive Order 110 (2003). Executive Order 110 relocated the Alcoholic Beverage Control Board from the Department of Revenue to the Department of Public Safety. The history note for former 13 AAC 104.335 carries forward the history from former 15 AAC 104.335.  
As of Register 203 (October 2012), and acting under AS 44.62.125(b)(6), the regulations attorney relocated former 13 AAC 104.335, and made conforming technical changes to 3 AAC 304.335, to reflect ch. 55, SLA 2012. Chapter 55, SLA 2012 relocated the Alcoholic Beverage Control Board from the Department of Public Safety to the Department of Commerce, Community, and Economic Development. The history note for 3 AAC 304.335 carries forward the history from former 13 AAC 104.335.
