Section 4.33.070. Alaska school for the deaf.

(a) The Department shall operate a centralized program for the deaf available to deaf students in the state. The program shall provide residential services as part of its educational program. The program may be operated by a school district under an agreement with the department, based on an annual plan of service approved by the department. (b) If a school district operates the centralized program for the deaf under (a) of this section, that school district shall perform all duties of a local school district related to special education under state and federal law, except that the district is not required to offer transportation to students who do not reside in the district. (c) If a school district determines that placement at the centralized program for the deaf under (a) of this section is appropriate for a child who resides in the district, the district that makes the placement retains the district's responsibilities for special education for that child under state and federal law. (d) Funding for the students who attend the centralized program for the deaf operated by a school district under (a) of this section will be provided to the district that operates the program.
