Section 4.52.610. Removal of surrogate parent.

(a) The procedures established under 4 AAC 52.590 must provide that a surrogate parent will be removed by the district if (1) the surrogate parent requests removal; (2) the surrogate parent fails to act with reasonable diligence on behalf of the child; (3) the surrogate parent is not qualified to act as a surrogate parent under 4 AAC 52.600; (4) the surrogate parent engages in actions which threaten the welfare of the child; or (5) the circumstances which gave rise to appointment of the surrogate parent no longer exist. (b) The district shall provide an opportunity for impartial review of a decision to remove a surrogate parent. The final decision of a district to remove a surrogate parent is not subject to appeal to the department.
