(a) In the Bristol Bay Area, an owner, operator, or employee of a lodge, charter vessel, or other enterprise that furnishes food, lodging, or sport fishing guide services, as defined in 5 AAC 75.995, may not furnish to a client or guest of that enterprise, finfish that has been taken under this chapter, unless the (1) finfish has been taken with gear deployed and retrieved by the client or guest; (2) gear has been marked with the client's or guest's name and address, as specified in 5 AAC 01.010(h) and 5 AAC 01.320(f); and (3) finfish is consumed by the client or guest or is consumed in the presence of the client or guest. (b) The owner, operator, or employee of a lodge, charter vessel, or other enterprise that furnishes food, lodging, or sport fishing guide services, as defined in 5 AAC 75.995, may not deploy, set, or retrieve their own gear, or take finfish, in a subsistence finfish fishery when a client or guest of that enterprise has subsistence fishing gear deployed or is in possession of subsistence-taken finfish that are stored at the lodge or enterprise.
