(a) In the Kodiak Area, an owner, operator, or employee of a lodge, charter vessel, or other enterprise that furnishes food, lodging, or sport fishing guide services, as defined in 5 AAC 75.995, may not furnish to a client or guest of that enterprise, finfish that have been taken under this chapter, unless the (1) finfish have been taken with gear deployed, operated, and retrieved by the client or guest; (2) gear has been marked with the client's or guest's name and address, as specified in 5 AAC 01.010(h); and (3) finfish is consumed by the client or guest or is consumed in the presence of the client or guest. (b) A sport fishing guide or charter vessel operator may not deploy, operate, have deployed, or retrieve subsistence finfish gear or possess subsistence-taken finfish while paying clients are on board the charter vessel or present at a fishing site.
