Section 5.41.260. Inspection of an aquatic farm or hatchery.

(a) An aquatic farm or hatchery operation permit holder shall retain a copy of the operation permit, including any amendments, and make it available upon the request of a representative of the department or the Department of Public Safety. (b) For the purpose of inspecting and monitoring compliance with the terms of the aquatic farm or hatchery operation permit or the requirements of this chapter, an aquatic farm or hatchery operation permit holder shall allow inspection of the aquatic farm or hatchery site by a representative of the department if the department notifies the permit holder at least 48 hours before the inspection. (c) If an aquatic farm or hatchery operator is not in compliance with the terms and conditions of the operation permit for the facility, the commissioner will issue a notice of non-compliance under 5 AAC 41.250. (d) Nothing in this section precludes the enforcement of other fish and game laws and regulations.
