Section 5.92.042. Permit to take foxes for protection and enhancement of migratory birds.

  • 	(a)  The department may issue a permit to take foxes for the purposes of protecting or enhancing the recovery of nesting migratory birds. The issuance of a permit must  
    		(1) be supported by a plan of operations that includes an adequate justification for fox removal, such as protection of threatened or endangered species, restoration of secure breeding areas, and enhancement of diminished nesting colonies; and  
    		(2) demonstrate sufficient positive benefits to migratory birds.  
    	(b)  A permit issued under this section must include  
    		(1) the name of the permittee and authorized subpermittees;  
    		(2) the species and number of foxes to be taken;  
    		(3) methods and means that may be employed;   
    		(4) duration of the permit;   
    		(5) location of the permitted activities;   
    		(6) disposition of the foxes that are taken; and   
    		(7) reporting requirements.  
    	(c)  The department must provide annually, to the Board of Game, a report of program activities and permits issued during the preceding 12 months.
