Section 5.92.068. Permit conditions for hunting black bear with dogs.

(a) The department will issue a permit for hunting black bear with dogs as provided for in 5 AAC 92.085(5). A permit issued under this section (1) is valid only for the time period and geographic area specified in the permit; (2) is nontransferable and requires the permittee to be present when the dogs are used for hunting black bear; and (3) may limit the number of dogs that can be used simultaneously to hunt black bear. (b) Once a black bear is treed, cornered, or otherwise restrained, it must be either harvested or allowed to go free. If the bear is allowed to go free, the dogs must be leashed and restrained from further pursuit of the bear. (c) A permittee using dogs to hunt black bear may not release the dogs to hunt black bear within one mile of an occupied dwelling. (d) A permittee shall surrender a permit to the department upon receipt of notification from the department that the department has determined that the permittee has violated any of the conditions set out in (a), (b), or (c) of this section.
