Section 6.25.541. Residence address information on the absentee in-person or questioned ballot envelope.

  • 	(a)  The oath and affidavit envelope prepared by the director for use by a voter voting an absentee ballot in person or through a personal representative or voting a questioned ballot at a polling place on election day may provide space in which the voter may write the voter's current residence address. Failure of the voter to provide an address in the space made available for that purpose will not cause the ballot to be rejected.  
    	(b)  If the voter provides an address and the address is different from that appearing on the voter's current registration record, the residence address provided will be considered in determining the voter's eligibility to vote in the election, and in the senate, house, or judicial district in which the voter voted, in accordance with the provisions of AS 15.20.211.  
    	(c)  Providing an address that is different from that appearing on the voter's current registration record will cause the ballot to be rejected or cause the district portion of the voter's ballot not to be counted, if the address provided on the voter's executed certificate is sufficient to  
    		(1) overturn or rebut the presumption of voting residence established on the voter's existing registration record; and  
    		(2) determine the voter's intention to set out the voter's new residence address.  
    	(d)  An address or other information provided on the voter's executed certificate is sufficient to overturn the presumption of voting residence or to determine the voter's intent to set out a new residence address if the information provided is a  
    		(1) street address or other description of physical location identified as the voter's residence address which does not appear as a residence address or permanent mailing address on the voter's existing registration record; or  
    		(2) statement that the voter does not have a residence address in Alaska; or  
    		(3) statement that the voter is not a resident of Alaska.  
    	(e)  An address or other information provided on the voter's executed certificate is not sufficient to overturn the presumption of residence as it appears on the voter's existing registration record or to determine the voter's intent to set out a new residence address if the information provided is a  
    		(1) post office box, postal service center box, rural route number, postal mail stop, or any other address commonly intended as a mailing address;  
    		(2) statement explaining that the voter's absence from the state is due to an allowable circumstance described in AS 15.05.020(1); or  
    		(3) repealed 8/22/2004.
