(a) The executive director and the respondent may engage in reasonable discovery. Unless otherwise ordered or agreed to by the parties, the rules for discovery in civil proceedings in the courts of this state apply, except that the initial disclosure requirements of those rules do not apply. The commission strongly encourages informality and cooperation between parties in the discovery process. (b) The executive director shall make the investigative file available to the complainant and respondent upon request within a reasonable time after issuing the accusation. Records and information required to be kept confidential by law must be withheld from disclosure.
