Section 7.05.500. Emergency procedures.

  • Under emergency conditions, including to ensure the protection of the body from loss or destruction, or to avoid long delays when transportation is immediately available but otherwise irregular, and if a question of foul play or suicide requiring an official investigation does not exist, a body or fetus may be moved from an isolated area, or to a place where the body may be prepared for final disposition or shipment, without a burial-transit permit when it is impossible to contact the proper authority to request the permit before removal. In this emergency case, the person in charge of the movement shall immediately proceed to obtain the required permit; and a person, agency, or common carrier providing this emergency transportation shall at once notify the proper local registrar or the state medical examiner of the removal. This emergency removal may not be made by a common carrier unless all other requirements have been met, and unless any passengers aboard can be adequately protected from any danger or undue discomfort from the emergency transportation.
