Section 7.05.855. Form and hearing.

  • The form for a petition for a court order establishing a record of birth shall be prescribed and furnished by the bureau, and shall contain the items required by the Vital Statistics Act, as well as any further information requested; and shall be properly signed and sworn to by the petitioner. The petition shall be accompanied by the required statement by the State Registrar refusing to register such birth; by all documentary evidence which was previously submitted to the bureau; and by any further evidence or other pertinent information. In fixing a time and place for hearing the petition, the State Registrar shall be given at least 15 days notice of such hearing, and the opportunity to appear and testify in the proceeding, or to submit a written statement pertaining thereto for the information of the court.
